5alty Merchant Portal Terms of Use
Version 1These terms govern how your shop and your team use the 5alty merchant portal.
The signed commercial agreement between your shop and 5alty sets the commission, payments and commercial obligations. These terms cover only the use of the portal. If they conflict with the commercial agreement, the commercial agreement prevails.
1. The portal and your account
- The portal lets you run your shop on 5alty: orders, menu and prices, availability, hours, branches, offers, deposits, reports and statements.
- Sign-in is by a one-time code sent to your email or mobile. Every team member has their own sign-in, and no one may use someone else's.
- The shop is responsible for anything done from its team's accounts.
2. Team accounts
- There are three roles: owner, manager and staff.
- Only the owner can add or remove team members, and manage branches and shop details.
- Owners and managers can change prices, availability, hours and the menu, and see the statement.
- Staff handle orders.
- When someone leaves your shop, remove them from the team straight away.
3. Accurate shop and menu
- You are responsible for making sure the shop's name and details, menu, descriptions, photos, ingredients and sizes are accurate and match what you actually sell.
- Prices on 5alty must be accurate. 5alty shows the price you set.
- When a product runs out, mark it «خلص» (sold out) straight away, until a set time or until you bring it back. The product stays visible to customers as unavailable.
- Each branch's opening hours must be correct. If you close early or need a break, use "pause orders" in the portal.
- The shop is responsible for the quality, safety and expiry of its food and goods, and for holding the licences and following the laws that apply to its business.
- Photos you upload must be yours or ones you have the right to use, and you give 5alty the right to show them in its apps, websites and marketing for as long as your shop is on 5alty.
4. Orders
- Accept or decline orders promptly. An order not accepted within the time 5alty sets may be cancelled automatically.
- Prepare the order complete, correct and well packed, in the time you state.
- If an item is unavailable, mark it «خلص» and tell support straight away, before the rider picks up.
5. Commission, payouts and settlement
- 5alty takes a commission as a percentage of the sales value. The percentage is set in the commercial agreement.
- The portal shows a statement with sales, commission, deposits, offers, claim deductions and payments.
- 5alty pays what it owes you on the schedule and by the method set in the commercial agreement.
- Check your statement, and raise any objection within the period set in the commercial agreement.
6. Deposits (تأمين)
Some products carry a deposit paid by the customer, such as cylinders, jerrycans and returnable containers. You can set the deposit for a brand or a product. There are two modes:
- Deposit held by the shop: the customer pays it in cash to the rider, who hands it to the shop. When the customer returns the item, the shop refunds the deposit to them directly. Record in the portal whether the item came back.
- Deposit held by 5alty: the customer pays it with the order and 5alty holds it. If the item comes back, the deposit is refunded to the customer's wallet. If it is not returned within 14 days, or is recorded as not returned, the deposit goes to the shop in settlement.
If the order is cancelled before delivery, the deposit is refunded to the customer.
7. Price offers
- Offers on your products are set up by agreement between the shop and 5alty, and appear in the portal.
- Every offer states who funds the discount: the shop, 5alty, or both in an agreed split.
- Where 5alty funds the discount, the shop is paid as if the product sold at its normal price.
- Where the shop funds the discount, it is deducted from the sales value in settlement.
8. Claims charged to the shop
- If a customer reports a missing, wrong or faulty item, 5alty may refund the customer first.
- The 5alty team reviews the claim. If the shop is found to be at fault, the claim amount is deducted from what 5alty owes the shop and appears on the statement.
- If you think a claim is unjustified, you can object through support and we will review it again.
9. Suspension
5alty may pause a branch, stop it from taking orders, or suspend the whole shop if:
- There are repeated complaints about quality, safety or order accuracy.
- Details or prices are not accurate.
- Amounts owed to 5alty are unpaid.
- You break these terms, the commercial agreement or the law.
We will tell you why, and give you a chance to fix the problem where appropriate. Where customer safety is at risk, suspension is immediate.
Ending the relationship altogether happens under the commercial agreement.
10. Data and privacy
- Customer data that reaches you (such as the first name and order details) is for preparing the order only. Do not use it for marketing or share it.
- We handle your team's data under the privacy policy, which covers every 5alty app and has a section for the merchant portal.
11. Liability
- The shop is responsible for its goods, and indemnifies 5alty against any claim by a customer or an authority caused by the shop's goods or its breach of the law.
- To the fullest extent the law allows, 5alty is not liable for indirect loss, such as loss of profit.
12. Law and changes
- These terms are governed by the laws of the Arab Republic of Egypt, and the competent Egyptian courts decide any dispute, unless the commercial agreement provides otherwise.
- We may change these terms. We will tell you in the portal and ask you to accept the new version the next time you sign in.
